The Predatory Effects of Copyright Piracy

چکیده
Developing countries are often considered non-stakeholders in effective copyright enforcement because they have not built up robust copyright industries, and copyright piracy therein mostly targets the works of foreign copyright owners. It is also argued that, while copyright piracy mainly undermines the incentive to produce and the ability to compete on the part of foreign firms, local firms might actually have a competitive edge and be able to enjoy a healthier growth. Although various international treaties such as the Berne Convention and the TRIPS Agreement have harmonized national copyright laws at a rather high level, many developing countries regard such legislative initiatives only as a trade-off in international trade negotiations. In exchange for stronger copyright protection to secure export markets for intellectual products from developed countries, developing countries receive lower tariffs on their own exported products such as textile and agriculture. It turns out that multinational firms, which hold dominant positions in the copyright market, are not in a hurry either to enforce their copyrights against piracy in developing countries. Bill Gates once indicated that “although about 3 million computers get sold every year in China, people don’t pay for the software. Someday they will, though. As long as they’re going to

Copyright Piracy as Prey-Predator Behavior
The economic analysis of the piracy of copyright products has used a variety of modeling assumptions, the majority of which are set in typical industrial organization settings. The results of such models are manyfold, but in general they are ambiguous as to the optimal protection strategy, and the effects of protection on the welfare of copyright holders, and on the existence of piracy. Concret...

متن کاملA model of piracy
This paper develops a simple model of software piracy to analyze the short-run effects of piracy on software usage and the long-run effects on development incentives. We consider two types of costs associated with piracy: the reproduction cost that is constant across users and the degradation cost that is proportional to consumers’ valuation of the original product. We show that the effects of ...

The copyright industries continued to confront very high piracy rates and losses in Romania during 2001 because of systemic inaction by government authorities, a pattern that has repeated itself over the past few years. Improvements made to the copyright and criminal laws in the mid1990s, combined with some cooperation from the police for some industries, still have not been enough to reduce ra...
متن کاملSoftware Piracy Forensics: Impact and Implications of Postâ•’Piracy Modifications
Piracy is potentially possible at any stage of the lifetime of the software. In a post-piracy situation, however, the growth of the respective versions of the software (both the original and pirated) is expected to be in different directions as a result of expectedly different implementation strategies. This paper shows how such post-piracy modifications are of special interest to a cyber crime...
